Red Bull settled a false advertising lawsuit recently, and now they owe anyone and everyone who had bought one of their drinks between Jan. 1, 2002 and Oct. 3, 2014. You will get either $10 in cold hard cash or you can get $15 of Red Bull Products.
In the settlement Red Bull agreed to pay American customers $13 million.
In the claim the plaintiffs said that the company’s advertised benefits, such as increased performance and reaction to speed, were all false advertising with no real scientific evidence. One plaintiff even claimed that since consuming their products he saw absolutely no improvements in his athletic abilities.
According to the lawsuit:
Such deceptive conduct and practices mean that [Red Bull’s] advertising and marketing is not just ‘puffery,’ but is instead deceptive and fraudulent and is therefore actionable.
Even though Red Bull did settle they still deny any wrongdoing with this statement:
Red Bull settled the lawsuit to avoid the cost and distraction of litigation. However, Red Bull maintains its marketing and labeling have always been truthful and accurate, and denies any wrongdoing or liability.
